Chapter 7 Bankruptcy
Generally speaking, Chapter 7 is the simplest form of bankruptcy. It is also the form of bankruptcy filed most frequently filed. This is because, in filing Chapter 7 bankruptcy, the debtor’s assets, unless protected by an exemption (e.g. home, car, pension, personal belongings) are sold by a court-appointed trustee and all creditors are paid off (typically partially) by the proceeds. In other words, the debtor comes away from the experience free of debt while his/her creditors receive recompense according to a legally established code of priorities. The downside of Chapter 7 bankruptcy is that the process will damage your credit for up to 10 years after the proceeding.
Chapter 13 Bankruptcy
If Heritage Legal helps you file for Chapter 13 bankruptcy, you will end up paying off a percentage of your debts by using your disposable income (the money left over after you pay taxes, maintenance, and support, to make monthly payments to your creditors. These payments (amounts determined by the court) will be made to a trustee for 5 years (occasionally shortened to 3 years). The major advantage of this type of bankruptcy is that it prevents foreclosure.
Both types of bankruptcy make it illegal for your creditors to continue to harass you. It’s important to be aware, however, that certain types of debt are not discharged through bankruptcy.
